Definitions

Government regulations stipulate that willful misrepresentation of business status as a Small Business, Minority owned Small Business, or Women owned Small Business for the purpose of obtaining a subcontract is subject to penalty. The following are based on the Federal Acquisition Regulation (FAR) 19.001 definitions

    “Small Business” shall mean a business that is independently owned and operated, not dominant in the field of operation, and qualified as a small business under the criteria and size standards as defined by the Small Business Administration.

    “Minority Owned Small Business” shall mean a small business concern

    1. Which is at least 51 percent owned by one or more minority, or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more minority.
    2. Whose management and daily business operations are controlled by one or more of such individuals.

The Contractor shall presume that minorities include Black Americans, Hispanic Americans, Native Americans, Asian-Pacific Americans, Asian-Indian Americans and other minorities as identified by the Administration pursuant to section 8(a) of the Small Business Act.

    “Small Business”“Women Owned Small Business” shall mean a small business concern
